arguments over the lawsuit (Florida, et al Vs. Department of Health and Human
Services) brought by 26 states and the National Federation of Independent

01/05/2012 - Important Medicare Update 1/5/2012
On Friday, December 23, 2011, President Obama signed into law the legislation necessary to temporarily prevent the scheduled Medicare SGR related payment cut for physicians and other practitioners from taking effect on January 1, 2012. The negative update for the 2012 Medicare Physician Fee Schedule is now scheduled to take effect on March 1, 2012. The legislation also extended a number of other "expiring provisions" that will have an impact on various providers.

As of 12/19, the House and Senate appear unable to reach agreement
on a "fix" to the SGR cut scheduled to take effect on January 1. Each
respective body has enacted legislation postponing the cut but they are
in disagreement on the length of the postponement, as well as how to
pay for the short-term fix.
12/14/2011 - SGR Update - Dec 14, 2011
Late yesterday, the House of Representatives passed a
bill, H.R. 3630 that would, among other things, "fix" the SGR problem
for 2 years. Under this bill, instead of a 27.4% cut in the Medicare
Physician Fee Schedule Conversion Factor (CF) due to the SGR, there
would be a 1% increase in the Medicare Conversion on January 1, 2012.
In addition the bill would authorize another 1% increase in the CF on
January 1, 2013.
If Congress fails to fix the SGR between now and the end of
2013, the SGR formula would mandate a cut in the CF in excess of 30% on
January 1, 2014.
